BOTTEGA DEI DUE MONTI di Stefano Mirella — Via Piave 59, 98071 Cap’Orlando (ME) — VAT 01541130835 — REA Messina 145604
Pursuant to Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 21/2014 implementing EU Directive 2011/83/EU on consumer rights.
1. Scope
These General Terms and Conditions of Sale govern purchase contracts concluded through the website www.bottegadeiduemonti.it between BOTTEGA DEI DUE MONTI di Stefano Mirella (hereinafter “Seller”) and consumer or professional customers (hereinafter “Buyer”).
Submitting the order implies full acceptance of these conditions. We recommend saving or printing them before completing the purchase, pursuant to art. 51 of the Consumer Code.
2. Products, Prices and Food Information
The products offered are described in the respective product pages, with information on ingredients, allergens, nutritional values and storage methods, in compliance with EU Regulation 1169/2011 on food information.
Prices are expressed in Euros (€) and include VAT. The Seller reserves the right to change prices at any time; the Buyer is charged the price shown at the time of order confirmation.
Product images are for illustrative purposes only; the appearance, weight and packaging may vary slightly based on the seasonal and artisan availability of products.
3. How the Purchase Works
The purchasing process at Bottega dei Due Monti consists of three stages, designed to guarantee maximum transparency for artisan and variable-weight products.
Stage 1 — Submit your request
Add products to the cart. As these are artisan foods (cured meats, cheeses, preserves), weights can vary piece by piece: prices shown in the cart are therefore to be considered as indicative estimates, not final.
No payment is requested at checkout. The final button reads “Send the order to the Bottega”: this is an order request, not a completed purchase. You will receive a confirmation e-mail.
Stage 2 — The Bottega verifies and sends you the final quote
Our staff checks product availability, weighs the actual items and prepares the quote with the final prices. You will receive an e-mail with:
- the order summary with prices updated to actual weights;
- a link to accept, refuse or modify the request.
Stage 3 — Confirmation and payment
Via the link received by e-mail you can:
| Effect | |
|---|---|
| Accept | You are redirected to the payment page to complete the order at the final total. |
| Refuse | The request is cancelled with no charge. |
| Modify | The cart is repopulated with the items: you can change quantities and submit a new request. |
Payment (by credit card or PayPal) takes place only at this stage, on the approved final total, and not when the initial request is submitted. If after accepting you do not complete payment within 15 minutes, you will receive an automatic reminder by e-mail.
The sales contract is considered concluded at the moment of successful payment.
4. Orders
The order is confirmed when the Seller sends a confirmation e-mail containing the order number and a summary of the products purchased. Until that confirmation, the order is to be considered as a purchase proposal.
The Seller reserves the right to refuse orders in the event of:
- product unavailability;
- unverifiable payment details or unauthorised transaction;
- incomplete or unreachable delivery addresses;
- abnormal or suspected fraudulent orders.
In the event of refusal, any amount charged will be fully refunded.
5. Payment Methods
Only the following payment methods are accepted, charged at the time of order:
- Credit / debit card: Visa, Visa Electron, Postepay, Mastercard, American Express, Maestro — via secure payment gateway (SSL/TLS connection).
- PayPal: via PayPal account or linked card.
Cash on delivery and bank transfers are not accepted. Credit card data does not pass through the Seller’s servers and is not stored.
6. Shipping and Delivery
Shipments are managed through Packlink PRO Shipping with the contracted couriers available at the time of the order. We ship throughout Europe.
Shipping costs are calculated automatically based on weight, dimensions and destination, and are always visible in the cart before confirming the order.
- Free shipping for orders totalling ≥ € 80.00, valid exclusively for destinations in Italy (including islands).
- For European destinations the cost is calculated at checkout.
Perishable products are shipped vacuum-sealed, in modified atmosphere or with refrigerated packaging, depending on the product type, to ensure the cold chain until delivery.
For full details on delivery times, couriers and packaging methods please see the Shipping Information page.
7. Right of Withdrawal
For eligible products, the consumer may exercise the right of withdrawal within 14 days of receiving the goods, pursuant to art. 52 of the Consumer Code.
Pursuant to art. 59(d), the right of withdrawal does not apply to perishable food products or products with a short shelf life, which constitute the majority of the Bottega dei Due Monti range.
For full details please see the Return and Refund Policy.
8. Non-Conforming Products or Delivery Anomalies
As the majority of products are food items, the two-year legal guarantee for durable consumer goods (arts. 128–135 Consumer Code) does not apply.
In the event of a product received wrong, damaged or with obvious anomalies at delivery (intact packaging but already expired, organoleptic defects detectable upon opening), the Buyer must report this within 48 hours of receipt by sending photographs of the product and the label to info@bottegadeiduemonti.it. The Seller will assess on a case-by-case basis whether to replace or refund.
9. Liability
The Seller is not liable for damages arising from force majeure (exceptional events, strikes, natural disasters, logistical blockages), from wilful misconduct or negligence of the Buyer or third parties, nor for non-delivery attributable to incorrect data provided by the Buyer at the time of ordering.
10. Privacy
The processing of personal data is governed by the Privacy Policy and the Cookie Policy, available on the website.
11. Alternative Dispute Resolution (ADR/ODR)
A consumer residing in the European Union may use the European platform for online dispute resolution:
https://ec.europa.eu/consumers/odr
Seller’s e-mail for ODR procedures: info@bottegadeiduemonti.it
12. Applicable Law and Jurisdiction
The contract is governed by Italian law. For disputes with consumers, the competent court is that of the consumer’s place of residence or domicile, pursuant to art. 66-bis of the Consumer Code. For disputes with non-consumer parties, the exclusively competent court is that of Barcellona Pozzo di Gotto (ME).
